Terms of service

The short version: this is one person's researched opinion, we don't sell anything, and every purchase you make is with someone else.

1. Agreement

Lights Out Bedding ("we", "us") is published by Type 5 Marketing LLC. By using this site you agree to these terms. If you don't, that's entirely reasonable — please stop using the site. These terms apply to reading the site and nothing more; they cannot govern a transaction we're not part of.

2. This is information and opinion, not professional advice

Everything here is editorial opinion based on published specifications, material properties, and other people's testing, which we cite and link. It is not professional, medical, or health advice, and it is not a substitute for a doctor.

We deliberately don't publish medical content. If a page here mentions back or neck pain, it is discussing mattress support or pillow height as a matter of physics — nothing more. It is not a diagnosis, not a treatment plan, and not a claim that any product will relieve any condition. If you have a health concern, pain that won't go away, or a sleep disorder, talk to a qualified healthcare professional. Don't delay doing that because a bedding site said something. We are not qualified to weigh in, and we say so plainly.

3. We do not sell anything

This is the most important clause on the page. We are a publisher. We have no store, no inventory, no checkout, and we take no payment from you. Every product we write about is sold by a third-party retailer, in practice almost always Amazon.

When you buy something after clicking a link here:

  • Your contract is with that retailer, not with us. Their terms and conditions govern the sale.
  • Payment, shipping, delivery, damage in transit, returns, refunds, cancellations, warranty claims, and customer service are all between you and the retailer or manufacturer. We have no visibility into your order and no ability to intervene in it. We cannot look up your order, chase a delivery, or process a return, because we were never a party to any of it.
  • Trial periods and warranties are the seller's or the manufacturer's commitments, not ours. We report those terms as published and we'll tell you when they're weaker than they sound, but we can't honour them on anyone's behalf.

If a mattress arrives late, arrives wrong, or fails in year three, the people who can help you are the retailer and the manufacturer. We'd genuinely like to know about it — it's exactly the kind of thing that changes a recommendation — but we can't resolve it for you.

4. Affiliate relationship

We earn commission on qualifying purchases made through our links, principally through the Amazon Services LLC Associates Program. You pay the same price either way. The full disclosure, including the bias we do have, is here and you should read it — it's written to be checked, not skimmed.

5. Prices and availability belong to the retailer

Prices, discounts, and stock shown here are fetched from the retailer and stamped with the time we fetched them. They change constantly and without notice. If our data is more than 48 hours old the number disappears on its own rather than lie to you.

The price at the retailer's checkout is the real price — always. We make no promise that any price, deal, or item shown here is still available, and we're not liable for a price that moved between our fetch and your click. Retailers also make pricing mistakes, and they're entitled to correct them.

6. No warranty as to accuracy or completeness

We work hard to be accurate and we correct errors fast, but we make no guarantee that everything here is correct, complete, or current. Manufacturers reformulate products without changing the name. Specifications get restated wrongly at every step of the chain. Listings get merged. We can be wrong.

The site is provided "as is" and "as available", without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We don't warrant that the site will be uninterrupted, error-free, or free of harmful components. Your decision to buy a product is yours.

7. Limitation of liability

To the fullest extent permitted by law, Type 5 Marketing LLC, Lights Out Bedding, and anyone writing for it are not liable for any indirect, incidental, consequential, special, or punitive damages arising out of your use of this site or your reliance on anything in it — including any loss arising from a product you bought from a third-party retailer after reading about it here.

Where liability cannot lawfully be excluded, our total aggregate liability to you for any claim relating to this site is limited to the greater of the amount you have paid us — which is, and always will be, nothing— or one hundred US dollars ($100). Some jurisdictions don't allow certain exclusions, so parts of this section may not apply to you, and nothing here limits liability for fraud or for anything else that cannot be limited by law.

8. Our content

The writing, structure, and original graphics on this site are ours and are protected by copyright. Please don't republish pages wholesale, scrape the site to rebuild it elsewhere, or pass our work off as someone else's.

You're welcome to quote us. Take a reasonable extract, attribute it to Lights Out Bedding, and link back to the page. That's fair use as far as we're concerned and we won't come after you for it. Product names, logos, and trademarks belong to their owners — Amazon and the Amazon logo are trademarks of Amazon.com, Inc. or its affiliates — and we use them to identify products, which implies no endorsement in either direction.

9. Acceptable use

Don't use this site to:

  • Break the law, or infringe anyone's rights.
  • Scrape, crawl, or hammer the site in a way that degrades it for other readers, or try to get around technical limits.
  • Attempt to gain unauthorised access to the site, its servers, or anything connected to them.
  • Abuse the contact form — spam, bulk pitches, or attempts to defeat its anti-spam measures.
  • Impersonate anyone, including us.

10. Third-party links

We link out constantly: to retailers, to manufacturers, and to other publishers whose testing we cite by name. We don't control those sites and we're not responsible for their content, accuracy, products, or practices. A link is a citation or a route to a shop — it's not a guarantee of anything on the other end, and their terms and privacy policies apply once you arrive.

11. Changes to these terms

We may update these terms. When we do, the effective date at the top changes, and continuing to use the site means you accept the revised version. If we ever start selling something directly — we have no plans to — these terms would be rewritten first, not quietly stretched to cover it.

12. Governing law

These terms are governed by the laws of the United States and the applicable law of the state in which Type 5 Marketing LLCis organised, without regard to conflict-of-laws rules. If any provision is found unenforceable, the rest stays in force. If you use this site from somewhere else, that's on you as far as local law is concerned.
